- In the event of a clear pricing error (e.g., $1 instead of $100), we reserve the right to cancel the order and refund any amounts paid. You will be notified before cancellation.

However, some states (e.g., California, Connecticut, Kansas) do not allow limitations on how long an implied warranty lasts or the exclusion of implied warranties. In those states, this disclaimer applies only to the extent permitted by law.

Our total liability shall not exceed the amount paid by you for the product(s) giving rise to the claim.
This limitation does not apply to claims of gross negligence, willful misconduct, or personal injury/death, or where prohibited by law.
13. Indemnification
You agree to indemnify and hold harmless Whitehouse Blackmarket and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your violation of these Terms or your misuse of the Site.
14. Governing Law
These Terms and any dispute arising from them shall be governed by the laws of the State of New York, without regard to conflict of laws principles. If you reside in a state that prohibits the application of New York law to consumer contracts, the laws of your state will govern where required.
15. Dispute Resolution – Arbitration with Small Claims Exception
Any dispute arising out of or relating to these Terms or your purchase shall first be attempted to be resolved through good‑faith negotiations (email us at info@whitehouseblackmarket.lol). If not resolved within 30 days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- The arbitration shall take place in Brooklyn, New York, or via remote hearing if permitted.
- Exception: Either party may bring a claim in small claims court (subject to jurisdictional limits) instead of arbitration.
- You may opt out of arbitration within 30 days of your first purchase by emailing us with “OPT OUT OF ARBITRATION” and your order number.
Judgment on the arbitration award may be entered in any court having jurisdiction.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Shipping Policy, Return & Refund Policy, Privacy Policy, and Payment Policy, constitute the entire agreement between you and Whitehouse Blackmarket.
18. Changes to These Terms
We may modify these Terms at any time. Changes are effective immediately upon posting, with the “Effective Date” updated. Your continued use of the Site after changes constitutes your acceptance.
19. Force Majeure
We are not liable for any delay or failure to perform caused by acts beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, supply chain disruptions, or government actions.
